This is an application for a new premises licence under the Licensing Act 2003 (“The Act”).
The premises is opening as a small deli occupying the ground and basement floor. There will be the sale of alcohol on and off the Premises. The Premises will also serve coffee, other hot drinks, breakfast, lunch, pastries and cakes, as well as deli items.

Issues raised by Objectors.
The EHS have agreed conditions with the Applicant. However, the hours exceed Core Hours and therefore representations are made on ground of public nuisance and public safety risk.
The residents have concerns about:
1) Excessive hours of trade. 2) Request delivery time restrictions. 3) Risk of anti-social behaviour.
Concessions confirmed by Applicant:
The Applicant in the additional Agenda Bundle has agreed to reduce the terminal time for the sale of alcohol (on and off sales), Mondays to Sundays 07:30 to 22:00
Policy Considerations
Policy HRS 1 states:

Policy RNT1 states:
A. Applications outside the West End Cumulative Impact Zone will generally be granted subject to: 1. The application meeting the requirements of policies CD1, PS1, PN1 and CH1. 2. The hours for licensable activities being within the council’s Core Hours Policy HRS1. 3. The operation of any delivery services for alcohol and/or latenight refreshment meeting the council’s Ancillary Delivery of Alcohol and/or Late-Night Refreshment Policy DEL1. 5. The application and operation of the venue meeting the definition of a restaurant as per the Policy.

Summary of the application
This is an application for a variation of a premises licence under the Licensing Act 2003 (“The Act”). The premises have had the benefit of a premises licence since January 2023 Since submission of this application, the premises licence has been transferred from London Cocktail Bars Limited to Mr Jonathan Bas.
Tequila Mockingbird is a licensed cocktail bar on the corner of Burleigh Street and Exeter Street. The premises has been operating successfully and without concern since March 2023.
The premises has operated using TENs until 03:00 without serious incident or any noise complaint.
The applicant has spoken with the EHO Noise Officer and Police Licensing Officer before submission who have expressed no concern to the proposed extension.
Further, a number of conditions are proposed to be amended and updated to reflect the new proposed closing time.

This Application is to Permit:
1. Extension of the licensable hours for all activities (performance of dance, live music, recorded music, anything similar to live music, recorded music or performance of dance, late night refreshment and sale by retail of alcohol) on Thursday, Friday and Saturday until 02:00
2. Extension of the opening hours on Thursday, Friday and Saturday until 02:30
3. To remove condition 14
4. To remove condition 32, 39 and 40 and replace with the Following condition:
“After 21:00, patrons permitted to temporarily leave and then re-enter the premises, e.g. to smoke or make a phone call, shall not be permitted to take drinks and glass containers with them, shall be limited to 15 persons at one time, and shall be restricted to the smoking area on Burleigh Street.”
5. To amend condition 28 to read:
“There shall be a minimum of not less than ONE SIA licensed door supervisors on duty from 20:00 hours, and an extra one SIA door supervisor on duty from 21:00, until close on a Thursday if the premises is to open until 02:00, unless agreed otherwise in writing with the Metropolitan Police.”

Summary of the application
This is an application for a new premises licence under the Licensing Act 2003 (“The Act”).
The premises is opening as a convenience store.
The Premises had the benefit a premises licence (14/04038/LIPT) was granted in 2005 for Chippenham Public House. This premises licence was suspended in November 2020 for non-payment of annual fees. A second premises licence (22/09214/LIDPSR) was granted in October 2019 to the Co-operative and was surrendered in December 2023.

Issues raised by Objectors.
The residents have concerns about:
1) Location is busy and this will add to parking, traffic and anti-social-behaviour. 2) Require a reduction of trading hours to 22:00 or sooner. 3) Already a number of supermarkets and licensed premises in the area. 4) Will cause loss of independent businesses and pubs.

Applications within the core hours set out below in this policy will generally be granted for the relevant premises uses, subject to not being contrary to other policies in the Statement of Licensing Policy.
