Membership

To note that Councillor Selina Short has replaced Councillor Peter Freeman as a member of the Sub-Committee.

Minutes:

1.1      There were no changes to the membership.

2.

Declarations of Interest

To receive declarations by Members and Officers of the existence and nature of any pecuniary interests or any other significant interest in matters on this agenda.

Minutes:

2.1      Councillor Robert Rigby explained that a week before the meeting, all four Members of the Sub-Committee were provided with a full set of papers including a detailed officer’s report on each application; together with bundles of every single letter or e-mail received in respect of every application, including all letters and e-mails containing objections or giving support. Members of the Sub-Committee read through everything in detail prior to the meeting.  Accordingly, if an issue or comment made by a correspondent was not specifically mentioned at this meeting in the officers’ presentation or by Members of the Sub-Committee, it did not mean that the issue had been ignored.  Members will have read about the issue and comments made by correspondents in the papers read prior to the meeting.

 

2.2      Councillor Mark Shearer declared that in respect of item 3, his company had advised the company purchasing the property and also that company’s advisers on several occasions. He therefore confirmed that he would withdraw from the Sub-Committee for this item and leave the room.

Minutes:

Erection of a single storey building on the north west of the site, relocation of the main entrance, remodelling of the ground and upper floors of the main building and associated landscaping and cycle storage improvements.

 

Late representations were received from Councillors Melvyn Caplan, Lorraine Dean and Matthew Green (17.02.2020 and 18.02.2020).

 

Elizabeth Humphreys addressed the Sub-Committee in support of the application.

 

RESOLVED UNANIMOUSLY:

 

That conditional permission under Regulation 3 of the Town and Country Planning General Regulations 1992 be granted.

Minutes:

Use of hard paved area outside Unit 1 adjacent to the canal basin for the placing of 31 tables, 112 chairs and 6 free standing umbrellas in connection with the use of Unit 1 as a bar/ restaurant.

 

Additional representations were received from Councillor Susie Burbridge (01.02.2020 and 07.02.2020).

That conditional permission be granted.

Minutes:

Retention of one external air condenser unit and new ducting on rear ground floor flat roof; installation of full height extract duct to rear and internal works at basement level.

 

At this stage of the meeting, Councillor Mark Shearer withdrew from the Sub-Committee and left the room after his earlier declaration in respect of this item.

 

Additional representations were received from five local residents (11.02.2020 and 12.02.2020 x 4), Councillor Nickie Aiken (11.02.2020) and DWD (13.02.2020).

 

Late representations were received from DWD (14.02.2020), The Boisot Waters Cohen Partnership on behalf of the Buddhist Society of Great Britain (14.02.2020, 17.02.2020, 18.02.2020), the Buddhist Society of Great Britain (14.01.2020), 28 local residents (14.02.2020 x 12, 16.02.2020 x 6, 17.02.2020 x 6 and undated x 4) and Eccleston Square Residents Association (14.02.2020).

 

The presenting officer tabled the following additional condition:

 

The draft decision notice has been amended to include an additional condition:

 

You must not operate the plant/ machinery that we have allowed (other than to carry out the survey required by this condition) until you have carried out and sent us a post-commissioning noise survey and we have approved the details of the survey in writing. The post-commissioning noise survey must demonstrate that the plant/ machinery complies with the noise criteria set out in conditions 4 and 5 of this permission.

RESOLVED (Councillors Robert Rigby and Selina Short for, Councillor Tim Roca against):

 

1.              That conditional planning permission and listed building consent be granted, subject to an additional planning permission condition as set out above.

 

2.        That the reasons for granting listed building consent as set out in Informative 1 of the draft decision notice be agreed.

Minutes:

Basement excavation beneath the existing driveway, erection of a conservatory at upper ground floor level, installation of an opaque glazed panel at ground floor level, provision of garden steps with associated fenestration alterations to the side elevation at 36 Westbourne Gardens.
