1.1  It was noted there were no changes to the membership.

 

1.2  RESOLVED: That Councillor Richard Elcho be elected as the substitue Chairman for the meeting in the event the Chairman loses connection or needs to stand down for an item.

Declarations of Interest

To receive declarations by Members and Officers of the existence and nature of any pecuniary interests or any other significant interest in matters on this agenda.

Minutes:

2.1       The Chairman explained that a week before the meeting, all four Members of        the Committee were provided with a full set of papers including a detailed           officer’s report on each application; together with bundles of every single           letter or e-mail received in respect of every application, including all letters             and emails containing objections or giving support. Members of the            Committee read through everything in detail prior to the meeting. Accordingly,           if an issue or comment made by a correspondent was not specifically     mentioned at this meeting in the officers’ presentation or by Members of the             Committee, it did not mean that the issue had been ignored. Members will             have read about the issue and comments made by correspondents in the           papers read prior to the meeting.

 

2.2       Councillor Elcho declared that in respect of item 5 is located in his ward however he advised that he has had no prior involvement with the application.

3.1       RESOLVED:  That, with the consent of the members present, the Chairman         signed the minutes of the meeting held on 18 August 2020 as a correct             record of proceedings.

Planning Applications

Applications for decision

1.

Luxborough Tower, Luxborough Street, London W1U 5BF pdf icon PDF 2 MB

Minutes:

 

Redevelopment of existing play space to provide a new building comprising a flexible Class D1 (non- residential institutions) use at ground floor level, 14 x affordable house units (7 x 1-bed and 7 x 2-bed) on first to fifth floors with associated access and other works including a subterranean rainwater harvesting tank; new plant, cycle parking, refuse storage and landscaping.  Removal of existing boundary railings and brick wall base adjoining Paddington Street Gardens North and construction of new boundary wall. (COUNCIL’S OWN DEVELOPMENT).

 

An additional representation was received from the Marylebone Association (07.10.20).

 

A late representation was received from the St Marylebone Parish Church (09.06.20).

 

Edward Buckingham addressed the Sub-Committee in support of the application.

 

Eric Robinson, Martin Scott and The Reverend Canon Dr Stephen Evans addressed the Sub-Committee against the application.

 

RESOLVED:

 

1.      That conditional permission be granted pursuant to Regulation 3 of the Town and Country Planning General Regulations 1992, subject to completion of a unilateral undertaking to secure the following:

 

a)     The provision of 14 intermediate affordable housing units in accordance with the affordability criteria specified by the Housing Development Manager.

 

b)     The provision of lifetime car membership (minimum 25 years) for each flat.

 

c)      A contribution of £24,824 (index linked) to the Carbon Offsetting Fund.

 

d)     Provision of a financial contribution of £10,000 (index linked) to plant two replacement street trees outside the site on Luxborough Street.

 

e)     Highway works outside the site in Luxborough Street.

 

f)       Provision of monitoring costs (£500 per head of terms).

 

2.      If the unilateral undertaking has not been completed within 6 weeks then:

 

a)     The Director of Place Shaping and Town Planning shall consider whether the permission can be issued with additional conditions attached to secure the benefits listed above. If this is possible and appropriate, the Director of Planning is authorised to determine and issue such a decision under Delegated Powers; however, if not;

 

b)     The Director of Place Shaping and Town Planning shall consider whether permission should be refused on the grounds that it has not proved possible to complete an agreement within an appropriate timescale, and that the proposals are unacceptable in the absence of the benefits that would have been secured; if so the Director of Planning is authorised to determine the application and agree appropriate reasons for refusal under Delegated Powers.

Minutes:

 

Demolition of existing buildings, construction of five storey building and extension of existing blocks to provide 20 flats with private balconies, bicycle storage, refuse storage and communal roof terraces.

 

A late representation was received from Philip Pank Partnership (13.12.20).

RESOLVED:

 

 

 

1.  That conditional permission be granted pursuant to Regulation 3 of the Town and Country Planning General

Regulations 1992, subject to completion of a S106 planning obligation to secure the following:

a)     Provision of the residential units as intermediate affordable housing in accordance with the affordability

       criteria specified by the Housing Development Manager.

b)     Provision of lifetime car club membershio (minimum 25 years) for each residential flat.

c)      Funding for atleration to the public highway in St John’s Terrace necessary to faciltate the development.

d)     A carbon offset contribution of £7741.50 (index linked and payable upon commencement of development)

e)     Provison of monitoring costs (£500 per head of terms).

 

2.  If the S106 planning obligation has not been completed within six weeks then:

 

a)     The Director of Place Shaping and Town Planning shall consider whether it would be possible and appropriate to issue the permission with additional conditions attached to secure the benefits listed above.  If so, the Director of Place Shaping and Town Planning is authorised to determine and issue such a decision under Delegated Powers; however, if not;

b)     The Director of Place Shaping and Town Planning shall consider whether permission should be refused on the grounds that the proposals are unacceptable in the absence which would have been secured; if so, the Director of Place Shaping and Town Planning is authorised to determine the application and agree appropriate reasons for refusal under Delegated Powers.

 

3.  That the Committee authorises the making of a draft order pursuant of s247 of the Town and Country Planning Act 1990 for the stopping up of parts of the public highway to enable this development to take place.  That the Director of Place Shaping and Town Planning, Executive Director of City Management, or other such proper officer of the City Council responsible for highway functions, be authorised to take all necessary procedural steps in conjunction with the making of the orders and to make the orders as proposed.  The applicant will be required to cover all costs of the Council in progressing the stopping up orders.
