Membership

To note that Councillor Ruth Bush has replaced Councillor Nilavra Mukerji.

Minutes:

1.1       It was noted that Councillors Tim Mitchell and Ruth Bush had replaced Councillors Angela Harvey and Nilavra Mukerji.

2.

Declarations of Interest

To receive declarations by members and officers of the existence and nature of any personal or prejudicial interests in matters on this agenda.

Minutes:

2.1       The Chairman advised that the committee are provided a week before the meeting with a full set of papers including a detailed officers report on each application together with bundles of every single letter or email received in respect of every application including all letters and emails containing objections or giving support and that they read through everything in detail prior to the meeting.  Accordingly, if an issue or comment made by a correspondent is not specifically mentioned at this meeting in the officers presentation or by members of the committee, it does not mean they have ignored the issue as they will have read about the issue in the papers prior to the meeting.

 

2.2       In respect of the applications on the agenda the Chairman declared in respect of item 7 that he had chaired the meeting when the application had previously been considered by the committee. In respect of item 8 he declared that he knows Jo-Anne Nadler, a former Wandsworth Councillor who had sent a representation to him. He advised that he had referred this to officers and had not discussed the matter with her.

 

2.3       Councillor Tim Mitchell declared that any members of the Majority Party who had or would make representations on the applications on the agenda were his friends. He also advised that in his capacity as a Ward Councillor for St James’s he has regular contact with landowners, developers and their agents on proposals which included some of the developers who had applications on the Committee’s agenda; however he had not received any presentations from them in relation to these. In respect of item 10 he declared that a husband of a current member of the Council had made representations on the application but that he had not discussed the matter with either of them.

 

2.4       Councillor Christabel Flight declared in respect of item 7 that she knows a number of people at Lord's, had received entertainment from the Marylebone Cricket Club and had sat on the committee when it had previously considered the redevelopment of the Warner Stand.

 

2.5       Councillor Bush declared that she is a trustee of the Westminster Tree Trust. In respect of items 4 and 5 she declared that the sites are located in her Ward. In relation to items 7 and 8 she declared that she had sat on the committee when the applications had previously been considered.

To sign the minutes of the last meeting as a correct record of proceedings.

1.

Eastgate House, 16-19 Eastcastle Street, W1 pdf icon PDF 2 MB

Minutes:

Details of proposed affordable housing provision elsewhere in the City of Westminster in accordance with Condition 1(2) of planning permission dated 6 November 2013 (RN: 13/08208) for use of the property as Class A1 retail on part basement and ground floor and part residential entrance (Class C3), and first to sixth floors as seven residential units (Class C3) and associated alterations and extensions including creation of roof terraces at third to sixth floor levels, alteration of roof top plant enclosures with associated installation of new plant, and installation of new shopfronts.

 

An additional representation was received from Councillor Jonathan Glanz (2.10.14).

 

RESOLVED: That consideration of the application be deferred so that members can view the viability appraisal and during this time the applicants are requested to consider a significantly higher affordable housing offer

Use of the public highway for the placing of 18 tables and 36 chairs in an area measuring 15m x 2.2m in connection with the existing restaurant.

Minutes:

The presenting officer tabled the following changes to the draft decision letter:

 

The plan numbers in the draft decision have been changed to reflect the changes to the design.

 

In addition, it is proposed to replace Condition 5 (removing PD rights in relation to new windows) with Condition 16 which also removes PD rights in relation to extensions and alterations, and re-number remaining conditions accordingly .

 

Informative that bricks ( to be reserved by condition) must match the neighbouring houses .

 

 

RESOLVED:

 

That conditional permission be granted subject to:

 

1.    No additional issues being raised prior to the expiry of the consultation period on 10 October 2014

 

2.    The changes to the draft decision letter as tabled and set out above and

 

3.    An additional informative that the colour of the bricks shall match as far as possible those of the adjoining houses.

The presenting officer tabled the following amendment to the recommendation:

 

The formal consultation with English Heritage in respect of the proposed demolition of the existing house and the impact of the new building on the setting of neighbouring listed buildings does not expire until 17th October 2014.  Therefore the recommendation is changed as follows:

 

Subject to no new issues being raised following the consultation with English Heritage which expires on 17th October 2014, resolved to grant conditional permission.
