Summary of Application
The Sub-Committee has determined an application for a New Premises Licence under the Licensing Act 2003 (“The Act”) in respect of 81 Edgware Road London W2 2HX (“The Premises”). The Premises trades as a Traditional Turkish dessert shop and café in the Hyde Park Ward.
This is a new Premises Licence and therefore no premises licence history.
The Applicant has provided in support of the application a written submission which can be found at Appendix 2 of the agenda report.
The Premises falls within the Edgware Road Special Consideration Zone. The onus is on the Applicant to demonstrate that they have addressed the local issues contained within Paragraphs D51 and D52 on pages 57 of the SLP.
Paragraph 51 states:-
Edgware Road area is 0.10km² in size, accounting for 0.4% of the borough’s footprint. The local issues that need to be considered by applicants are:
· Serious violent crimes at night. · Incidents relating to ambulance call outs at night to the locations of licensed premises for intoxication, injury related to intoxication and/or assault. · Drug dealing at night. · Robberies at night. · Theft incidents at night. · Noise nuisance at night.
Paragraph D52 states:-

The Applicant has now withdrawn recorded music from the application. The hours for Late Night Refreshment have also been amended as follows:-
Conditions have been agreed with the EHS (revised) and the MPS.

Summary of the Application
The Sub-Committee has determined an application for a Variation of a Premises Licence under the Licensing Act 2003 (“The Act”) in respect of Theatre Restaurant 6 Catherine Street London WC2B 5JY (“The Premises”). The Premises trades as a restaurant in the St James’s Ward. The Premises Licence Holder (“PLH”) is Mr Rene Tovar. The Designated Supervisor (“DPS”) is Trevilo Trading Limited.
The PLH seeks to vary the Premises Licence as follows:-
· To vary Condition 9 on the existing premises licence (effectively a relaxation of restaurant Model Condition MC66). · To add a new condition.
A new premises layout plan has been provided showing the area shaded red in accordance with the proposed amendment to Condition 9 which can be found at Appendix 1 of the agenda report.
The Applicant has provided in support of the application a written submission which can be found at Appendix 2 of the agenda report.
The Premises have had the benefit of a premises licence (23/08951/LIPRW) since 2013.
A copy of the licence can be found at Appendix 3 and the full premises history at Appendix 4.
The PLH has provided the following submissions:-
· A Mediation email for the interested party. · A presentation.

The Premises falls within the East Covent Garden Special Consideration Zone. The onus is on the Applicant to demonstrate that they have addressed the issues contained within Paragraph D53 on page 58 of the SLP.
Paragraph D53 states:-
· The East Covent Garden area is 0.09km² in size, accounting for 0.4% of the borough’s footprint. The local issues that need to be considered by applicants are:
Elevated levels of noise nuisance at night surrounding locations of licensed premises.
Condition 9 states:-
Proposed Condition to be added:-
· There shall be no more than 10 standing customers in the area shaded red on the licence plan at any one time.
The matter was assessed on its individual merits having regard to the evidence before the Licensing Sub-Committee and the promotion of the licensing objectives.
