The Sub-Committee has determined an application for a Variation of Premises Licence under the Licensing Act 2003 (“The Act”) The Premises currently operates as a Private Members’ Club specialising in fine wines and gourmet Mediterranean food, and had authorised licensable activities relating to Regulated Entertainment, Late Night Refreshment, and the Sale of Retail of Alcohol both on and off the premises. The Applicant was seeking to vary the existing licence by extending the terminal hour of all licensable activities and opening hours to 01:00 Monday to Saturday; and to amend condition 12 to permit use of the external first floor terrace until 22:00. The Applicant also sought to amend works conditions (30 and 31) to apply to the second floor only. The Premises are not located in any area of Cumulative Impact.

·       The EHS stated that the application proposals were likely to increase the risk of Public Nuisance and the hours sought for late night refreshment were in excess of the Core Hours as defined in the City Council's Statement of Licensing Policy (“SLP”). 

·       The resident objector stated that there are residents living nearby who could be adversely affected by the variation.

The Applicant originally applied to vary the terminal hour for the Sale by Retail of Alcohol for consumption on the Premises from Monday to Thursday 23:30 hours, Friday to Saturday 00:00 Hours and Sunday 22:30 to 02:00 Monday to Sunday subject to alcohol remaining ancillary to a table meal.
