Summary of the Application

This is an application for a new Premises Licence under the Licensing Act 2003 (“The Act”) in respect of 92-93 Berwick Street, W1F 0QB. The Premises intends to operate as a restaurant.

Submissions

The Chair introduced the Members of the Sub-Committee and outlined the procedure to the Parties in attendance. The Sub-Committee Members confirmed that they had no declarations of interest to make.

 

The Presenting Officer, Kevin Jackaman, Senior Licensing Officer, introduced the application for a new premises licence. He drew the Sub-Committee’s attention to an error in the officer’s report in respect of the hours for the sale of alcohol applied for.

 

Mr Matthew Butt KC, representing the Applicant, addressed the Sub-Committee explaining that the Licensing Authority had withdrawn their representation as the application was in line with policy and would promote the licensing objectives. He went on to explain that the premises would be trading as a restaurant within core hours. Mr Vince had previously run a bread stall opposite the premises for many years and Mr Waite had several successful businesses within the West End. Mr Butt advised that following concerns raised by local residents surrounding outside drinking the Applicant was prepared to amend the application so that there would be no tables and chairs outside. To achieve this, Mr Butt proposed deleting and amending the proposed conditions to remove references to outside tables and chairs. Mr Butt confirmed that the applicant would also be amenable to a new condition stating there would be no tables and chairs.

 

Mr Butt advised that the application as amended was within core hours for a comparatively low-capacity restaurant with no tables and chairs. The Applicant did not intend to use third party delivery providers but had agreed conditions with the Police in respect of delivery drivers. The Presenting Officer, Kevin Jackaman, Senior Licensing Officer, introduced the application for a new premises licence.

 

Mr Alun Thomas, representing the Applicant, addressed the Sub-Committee, noting that the Premises had just been used by L’Oreal for a pop-up event. He explained that not all events would be serving alcohol but some, such as Wimbledon screenings, would like to have that opportunity. Mr Thomas referred to product launches and fashion shows as other possible events. He explained that having a licence would help promote the licensing objectives and that a licence with appropriate conditions was far better than Temporary Event Notices (TENs). He went on to explain that the Applicant had proposed condition 10 which would restrict the sale of alcohol to 50 days per calendar year. He noted that the location was on the cusp of the Cumulative Impact Zone and that no representations had been received by individual residents.

 

Mr Thomas stated that the Environmental Health Officer felt that CCSOS1 was the closest fit; the Premises did not fall under PB1 as it was not a bar and the primary use was not the sale of alcohol. The Cumulative Impact Policy was focused on late-night and drink-led Premises, and the Premises would not add to cumulative impact.

 

In response to a question from the Sub-Committee, the Applicant stated that the intention was to use the space as a controlled environment and a cultural space.

 

In response to a question from the Sub-Committee, the Mr Thomas stated that the Applicant would consider a condition limiting the number of sporting events serving alcohol.
