Summary of Application

The Sub-Committee has determined an application for a New Premises Licence under the Licensing Act 2003 (“The Act”) in respect of 320-322 Elgin Avenue London W9 1JU (“The Premises”). The Premises operates as a supermarket in the Maida Vale Ward. This is an application for a new Premises Licence, and no Premises history exists.  There is a resident count of 366.

SUBMISSIONS AND REASONS

 

Mrs Sandra Robbie, Presenting Officer, outlined the application to the Sub-Committee. She advised that representations had been received from one local resident and the Paddington Waterways and Maida Vale Society.  She confirmed that representations had also been received from the Metropolitan Police Service (MPS) and the Environmental Health Service (EHS) however after agreeing conditions with the Applicant both parties had withdrawn their representations.  She confirmed that the Premises is located within the Maida Vale Ward but was not in a Cumulative Impact Area (CIA) or a Special Consideration Zone (SCZ).

 

Mr Robert Sutherland appearing on behalf of the Applicant outlined the application to the Sub-Committee.  He advised that the building was acquired in March 2022 and after substantive works was changed from what was previously a bank into the luxury grocery store.  He outlined that the application was a result of local people requesting to purchase alcoholic drinks alongside the groceries on offer within the luxury supermarket.  He confirmed that the Responsible Authorities had agreed conditions with the Applicant and considered that the conditions to be attached to the Premises Licencing would now promote the Licensing Objectives.

 

 

 

 

Mr Sutherland referred to the proposed conditions attached at Appendix Four, pages 85-89 of the report, and considered that conditions 23 and 43 should be deleted and condition 14 be attached to the Premises Licence because everything was covered by condition 14, which had been offered in the application.
