This is an application for the RENEWAL of a sex establishment licence (SEV) under Schedule 3 of the Local Government (Miscellaneous Provisions) Act 1982 (as amended by the Policing and Crime Act 2009) for The Windmill Theatre, 17 - 19 Great Windmill Street, London, W1D 7JZ (“The Premises”)

Issues raised by Objector.
1) Previous historical breaches of conditions by previous operators. 2) Increase in crime and poor management. 3) No security staff outside the Premises. 4) Hours should be reduced.
Policy Considerations
Suitability of applicant – SU1
The applicant has stated that no relevant offences have been committed. In addition, the Police and the Council’s Licensing Inspectorate have carried out fit and proper persons checks and have not made any objections to the application.

The Police and the Council’s Licensing Inspectorate have undertaken appropriate checks and have made no comments.

The appropriate number of sexual entertainment venues in the relevant localities is 25 in the Westminster core CAZ north. As the premises are currently licensed this application, if granted, will not exceed 25.
Character of the relevant locality – LO1
The premises is situated on Great Windmill Street, which is a thoroughfare crossed by Shaftesbury Avenue. Great Windmill Street is made up mainly of retail shops and restaurants. There is a resident count of 260 at a 100m radius.
Use of premises in the vicinity – LO2
The main use of the premises in the immediate vicinity are commercial. There is one sex shop and one school, with no places of worship within a 100m radius of the premises. A map of the relevant locality is attached to this report as Appendix F.
Layout, character or condition of the venue – LO3
The premises is spread over the basement, ground floor and first floors however no SEV activities takes place in the basement.

The MPS states conditions have been agreed. Their representation remains as the granting of the application will adversely impact on the area as the Premises is located in the SCZ.
The EHS states that the application is likely to cause an increase in public nuisance and impact on public safety.
The residents have concerns about:
1) The affect of the operation on their well being and mental health as a result of nuisance and loud music. 2) Music from the venue is loud. 3) Reports of nuisance to the Authority. 4) Noise of intoxicated people leaving the venue. 5) Private parties. 6) Blocking the public highway. 7) Opening times of the premises exceeded. 8) Blocking residents parking 9) Inconsiderate guests leaving and driving.
Policy Considerations
Policy SCZ1 applies:
In addition to meeting the other policies within this statement, applications within a designated Special Consideration Zone should demonstrate that they have taken account of the issues particular to the Zone, in question as identified within the 2020 Cumulative Impact Assessment, and should set out any proposed mitigation measures in relation to those issues within their operating schedule.

The EHS in the additional material maintains his objection solely because the residents have not withdrawn, and he may be able to provide an overview.
The residents have concerns about:
1) Noise from customers before and after performances. 2) Request signage requesting patrons to be quiet and respectful, commitment to dispersal and a commitment to addressing complaints. 3) Increase in hours. 4) Lack of supervision on Park Road and dispersal.
Policy Considerations
Policy CCSOS1 applies:
A. Applications outside the West End Cumulative Zones will generally be granted subject to: B. 1. The application meeting the requirements of policies CD1, PS1, PN1 and CH1. 2. The hours for licensable activities are within the council’s Core Hours Policy HRS1. 3. The operation of any delivery services for alcohol and/or late-night refreshment meeting the council’s Ancillary Delivery of Alcohol and/or Late-Night Refreshment Policy DEL1. 4. The applicant has clearly demonstrated that the sale by retail of alcohol and late-night refreshment will be ancillary to the venue’s primary function as a cinemas, cultural and live sporting venues and outdoor space. 5. The applicant has taken account of the Special Consideration Zone Policy SCZ1 if the premises are located within a designated area. 6. The application and operation of the venue meeting the definition for a cinema, cultural venue, live sporting premises or outdoor space.
