18/02/2020 - Award of Contract for Residential Care Services at Carlton Dene and Westmead

1.              That the Cabinet Member for Adult Social Care and Public Health agrees that the report be exempt from publication under paragraph 3 of Schedule 12A of the Local Government Act 1972 as it contains information relating to the financial or business affairs of a particular person (including the authority holding that information) and it contains information in respect of which a claim to legal professional privilege could be maintained in legal proceedings.

 

2.              That the Cabinet Member for Adult Social Care and Public Health gave approval by way of a direct award to enter into contract with the preferred bid for the period and costs as set out in the report.

 

3.              That the Cabinet Member for Adult Social Care and Public Health noted that this waiver approval and contract award was sought in accordance with the Public Contracts Regulations 2015, Part 2, regulation 32, which enables the use of a negotiated procedure without prior publication when the need is extremely urgent arising for unforeseeable events.

 

4.              That the Cabinet Member for Adult Social Care and Public Health delegated to the director of Adult Social Care and Public Health authority to agree to, in consultation with him, exercise the extension provisions in the contract which permit it to be extended for a maximum cumulation period and costs as set out in the report.  

 

5.              That the Cabinet Member for Adult Social Care and Public Health acknowledged and agreed that a waiver was supported by the Council’s Chief Procurement Officer to the requirements and process of Section 3.14 to conduct a competitive exercise in accordance of the borough’s Procurement Code.  

 

6.              That the Cabinet Member for Adult Social Care and Public Health noted the legal comments in section 11 of the report, and that a balanced approach to risk management be taken as set out in section 7of the report.

 

Reasons for Decision

 

The fundamental reason for awarding the interim contract to the preferred bidder is to ensure and secure immediate continuity of essential services to vulnerable residents currently living within Carlton Dene and Westmead or in need of the services at these homes.
